Welcome to https://lowerleftmnl.com (the “Site”). The following terms and conditions apply to all orders placed by customers (“user” or “you”) with Elite Sales Force International Inc. (“we” or “us” or “our” or “the Company”) the owner and operator of the Site.

By using, browsing, and/or placing an order, you have agreed to these terms and conditions set out herein (the “Terms”). Please read them carefully and make sure you have understood the terms before ordering from the Site.

We only allow persons of legal age or at least eighteen (18) years old, who are not under guardianship and are not acting in a capacity as a company to place an order.

We reserve the right to amend or change the Terms without prior notice. The version of the Terms that will be applied to your order will be those posted at the time the order was placed. 

To ensure the best possible online shopping experience for our customers, users are asked to understand and agree not to:

• Post, transmit, redistribute, upload, or publicize any content that could negatively impact us, our products, or our services;
• Act or use whatever tool that may restrain, limit, interfere or hinder any other user from accessing and enjoying the Site, or which would affect the Site’s security; or
• Utilize any tool or try to use any device, software, or other mechanisms to copy materials or to search and navigate the Site. We shall reserve the right to instantly block admission and block any user’s account that violates any of these Terms.

Limited Use and Site Access

We grant you a limited permission to access and make personal use of this Site, which access does not include the ability to download anything to it or modify it, or any portion of it. The limited use granted does not include any of the following:

1. Resale of commercial use of the Site or its contents;
2. Any collection and use of any product listings, descriptions, or prices;
3. Any derivative use of the Site or its contents; and,
4. Any use of data mining, robots or similar data gathering and extraction tools.

The Site or any portion thereof shall not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose. You may not frame or utilize any framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of the Company, and separate trademark owners, if included in the Site. Any unauthorized use automatically terminates the permission or use granted by the Company.

Prices and Delivery Charges

The prices shown at the Site do not include a delivery charge. The amount posted online may differ from prices in stores. The delivery charges will vary depending on the size or weight and delivery location of your order. Each amount for delivery will be indicated clearly during check-out. Inability to deliver orders fully that would require multiple deliveries will be charged additionally for any succeeding deliveries. 

Ordering

Orders will be completed once all details are properly supplied, after which an email confirmation will be sent to the email address provided. If for any reason there is an inability to accomplish your orders, you will be informed immediately.

Delivery

We strive to deliver all received and processed orders on the scheduled date, though some deliveries might take longer due to unexpected circumstances. 

The standard delivery time for areas within Metro Manila is 1-5 business days and for Provincial areas, 7-10 business days. 

Delivery will start from the time your orders are picked up from our warehouse. You may contact our customer service if your orders are not delivered on the scheduled date. 

Cancellation of Order 

Cancellation of orders may be allowed if the items are not yet shipped. You may contact our customer service for cancellation requests. Please be advised that customers will shoulder all costs of the returned items to our main office unless otherwise provided by applicable laws and regulations.

Refund for the cancelled orders will be provided by attempting to use the same method used to make the payment (the returned items will reflect in your account balance if the orders have not yet been paid for) as soon as possible, provided the receipt of the returned items were confirmed. Other payment methods may be used for the refund as long as you have given the consent to do so.

Return and Exchange

Damaged items can be returned within seven (7) days provided that all items are in their original packaging, unworn and unused with tags intact, and the original receipts included. Please be advised that all returned items will be subject to quality assessment to verify their condition. If return and exchange are approved and the same item is now available, you may select any item of the same amount. If the item is of higher value from the original purchase, the price difference must be paid. If the value is lower, the price difference is forfeited. 

All return and exchange costs will be shouldered by you and that change of mind is not a ground for a return or exchange approval.

Payment Methods

We accept Credit Card, Debit Card, GCash and Cash on Delivery (COD) as the modes of payment. Please take note that you will bear all the applicable bank charges, if any.

The shipping confirmation email will include the required sales invoice.

Disclaimer of Warranties and Limitation of Liability

This Site and all information contained herein are provided by the Company on an “as-is” and “as-available” basis. We make no representations or warranties of any kind, express or implied, as to the operation and availability of this Site or the information, content, materials, or products presented on the Site. You expressly agree that your use of this Site is at your own risk. To the full extent permissible by applicable law, the Company disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the Site, its servers, or email sent from us are free of viruses of other harmful components or errors. The Company will not be liable for any damages of any kind arising from the use of this Site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

The maximum amount we are liable to you for any loss or damage is relative to the sales made in this Site it the total price of your order. 

The Company shall not be liable for any delay or failure to carry out its obligations to any customer for reasons beyond its control, including without limitation, to force majeure, acts of God, war or terrorism, natural disasters, or compliance with laws, regulations or governmental policies and shortages of products, supplies and services. The Company may extend delivery of an order so affected without liability.

Colors and Size Measurements

We take special measures to accurately present our product’s features, in particular colors and composition. The settings of the device you are using may alter the product’s colors and we cannot assure you that the device you are using will display identical colors to the actual product.

Size measurements are provided on the Site. This may give you an impression of the model and the specific measurement or fit of a specific product. Please take note that these are only guides and do not guarantee the actual measurement of the item you receive. The actual measurements of a product may alter depending on the material used in its production.

Our Commitment

If there are any defects in the products you have purchased, we will abide and follow all laws and regulations on the matter. Let us know if you have any complaints or concerns regarding the damaged products, as well as those sustained during transit. You may contact customer service to have your items returned or exchanged.

Separation

If any component of the Terms is excluded or is deemed ineffective by any court or regulatory body, the other Terms shall remain in force. 

Rights of Ownership

Trademarks and copyrights at the Site will remain with the Company. Usage of any content from the Site including the storage, imitation, and duplication, other than for personal or non-commercial use, is prohibited without the authorization of the Company.

Governing Law and Exclusive Jurisdiction

These terms and conditions shall be governed by and construed in accordance with the laws and regulations of the Philippines. In the event of any dispute hereunder, you and the Company, hereby consent to submit to the exclusive jurisdiction of the courts of Muntinlupa City, to the exclusion of all other courts.
